第１回：なぜ特許出願をするのか？

近年、経済のグローバル化に伴って企業間の国際競争が激化し、知財を巡る状況も複雑化している。このような状況の下、適切な知財戦略を取ることが企業経営の鍵になっている。そこで、今回より計３回にわたり、知財を巡る最新動向を紹介すると共にそれに対応するための知財戦略を考えていきたい。知財＝知的財産権には、特許権、実用新案権、意匠件（デザイン）、商標権、著作権、営業秘密等が含まれる。よって特許を中心としつつも幅広く知財戦略を紹介していきたいと考えている。なお、本稿は筆者の個人的見解であり、特許庁の公式見解ではないことをお断りしたい。

サーフィン文化発祥の地LAで次世代サーフボード開発を！

最近至る所で「環境に優しい」や「グリーン」といったエコトレンドを生かしたプロダクト開発が進んでいる。自動車業界では、各社競ってハイブリッドカー市場への参入や次世代エネルギー開発へ投資を実施している。そんな「エコブーム」は、ここLA発祥のビーチカルチャーの代表でもあるサーフィン業界にも大きく影響している。長年サーフボードのプライマリサプライヤとして、サーフィン業界をサポートし続けてきたClark Form社が、２００５年１２月に自らの決意で突然そのドアを閉じた。当社は停止の真相を明らかにしていないが、EPA（米国環境省）の環境安全基準に見合わない器具や薬品を使用していた事が主要な原因と言われている。独占に近い状態だった世界最大のサーフボードブランク工場が一日にして停止したことを受け、業界ではこれを機に、サーフボード開発にも、「環境」という新たな要件が追加された。それから２年がたった現在のサーフィン業界では、新素材、そして新しい構造のサーフボード開発がより一層盛んになってきている。

これまでこのフォーラムという場を借りて、５回ほど連載させていただいた。まだ説明が足りない点や今後分析を深めていかなければならないところも多いが、ここまでのところで一つまとめてみたい。

JETROロサンゼルス 佐藤友香（研究アシスタント）
近年アメリカでは自治体を中心としたレジ袋削減に向けた取り組みが注目を集めている。
カリフォルニア州ではサンフランシスコ市及びサンタモニカ市がレジ袋無料配布の一部禁止やそれに向けた取り組みを開始している。ここロサンゼルス市も市と住民が一丸となって環境教育を促進し、計画的に多種の環境問題に対応し得るプログラムを作成するなど環境先進都市を目指しており、レジ袋の削減に関する対策案も検討されている。
日本の自治体では袋の有料化や無料配布の廃止などの規制を全域では行っていないが、自治体と事業者が地域自主協定を締結することでレジ袋の使用を市内の一部店舗で廃止するというようなモデル事業を進展させている。そこで今回は日米で積極的に行なわれているレジ袋削減事業の現状をみていきたい。

One out of six people lack access to safe drinking water and two out of six lack access to sanitation, noted David Peterson, CEO & President of Great Circle Water, during his March 25th presentation at the JETRO LA Office. Peterson discussed water issues and his own company's role in solving them as part of JETRO's 4th Tuesday Tech Exchange series. Over 20 people attended his talked, reflective of the growing concern about water issues in Southern California.

Technology Licensing

We will analyze the responsibilities that the Technology Transfer Office (TTO) has at different universities, among them being custodian of the Intellectual Property (IP) created by the faculty and students in their premises. In this role, the TTO tries to find suitable users of these technologies and to negotiate the best terms for both parties. In addition, they also do a lot of the work needed to create joint ventures, incubate potential spin-offs and work out the details a sale of IP when it seems to be the best way to unleash value for the university. |

Water, the New Oil

Climate change and demographic shifts are beginning to strain the world's supplies of fresh water in many regions, according to the U.N.'s second World Water Development Report, and if the issue is not addressed it will be a driver of humanitarian crisis in the 21st century. Recognizing this problem, there has been an groundswell in water technology innovation across the globe. Southern California, no stranger to water shortages due to many years of an extended drought, is a major center for this innovation. The March 8th Caltech/MIT Enterprise Forum focused on water innovation by bringing together representatives from water companies, VC and one of the L.A. area's biggest water technology customers, the Metropolitan Water District, to discuss the future of this industry and new opportunities. Over 80 entrepreneurs, VCs, academics and other people concerned with water issues attended the seminar.
